Terms of Service

By creating a Spark account or using the Spark app or website, you agree to these Terms. Please read them. They're written to be understood, not to obscure.

Who can use Spark

Spark is available to anyone who is 18 years of age or older. By creating an account, you confirm that you are at least 18. We use date of birth during onboarding to verify this. Accounts found to belong to users under 18 will be permanently removed.

Spark is currently invite-only and available in select cities. Access may be limited during our early launch phase.

Your account

You are responsible for your account and everything that happens through it. Keep your login secure. Do not share your account with others or create accounts on behalf of other people.

You must provide accurate information when creating your account — your real name, real photos, and accurate date of birth. Fake or misleading profiles are not permitted.

You may only maintain one active Spark account at a time.

What Spark is for

Spark is a platform for real-world connection. It's designed to help people who are open at the same time find each other and do something together — coffee, a walk, a night out, whatever fits the moment.

Spark is not a platform for commercial solicitation, political organizing, or any purpose other than genuine personal connection.

Community standards

Spark is a small, intentional community. We expect everyone to treat other members with respect. The following are not permitted on Spark:

Violations of these standards may result in account suspension or permanent removal, at our discretion.

Your content

You own the content you post on Spark — your photos, your bio, your messages. By posting content, you grant Spark Social LLC a limited license to display and deliver that content within the app as part of providing the service. We do not claim ownership of your content and we do not use it for advertising.

You are responsible for the content you post. Do not post content that:

Safety

Spark facilitates real-world meetups. Your safety matters to us, and we encourage you to exercise the same judgment you would in any real-world situation.

Spark is not responsible for the conduct of users in person. We are committed to removing bad actors from the platform promptly when reported.

Intellectual property

Spark™ is a trademark pending registration by Spark Social LLC. The Spark name, logo, app design, and all associated materials are the property of Spark Social LLC. You may not use them without our written permission.

Account termination

You can delete your account at any time from within the app. We may suspend or terminate accounts that violate these Terms, without notice in cases of serious violations.

When your account is terminated, your profile and personal data are deleted in accordance with our Privacy Policy.

Disclaimers

Spark is provided as-is. We do our best to keep the app reliable and safe, but we cannot guarantee uninterrupted service or that every connection made through Spark will be a good one.

To the extent permitted by law, Spark Social LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including damages arising from interactions with other users in person.

Governing law

These Terms are governed by the laws of the State of Missouri, United States. Any disputes arising from these Terms or your use of Spark shall be resolved in the courts of St. Louis County, Missouri.

Changes to these Terms

We may update these Terms as Spark grows and evolves. If we make material changes, we'll notify you through the app or by email before they take effect. Continued use of Spark after changes take effect constitutes acceptance of the updated Terms.

The short version: We collect what we need to make Spark work. We don't sell your data. We don't share it with advertisers. We're a small team building something real, and we treat your information accordingly.

We do not currently share your data with advertisers or sell your personal information to third parties. If this ever changes, we will notify you before it does.

Who we share your data with

We work with a small number of trusted service providers who process data on our behalf. They are only permitted to use your data to provide services to Spark, not for their own purposes.

We may also disclose your information if required by law, court order, or to protect the safety of our users or the public.

Location data

Spark uses your location to show you moments and people nearby. We do not share your precise location with other users — they see your neighborhood or general area, not your exact coordinates.

If you choose not to grant location access, you can manually enter your city or neighborhood. Some location-based features may be less precise without GPS enabled.

Your photos

Profile photos you upload are stored via Cloudinary and visible to other Spark users. You can update or remove photos at any time through the app. When you delete your account, your photos are removed from our systems.

Data retention

We keep your data for as long as your account is active. When you delete your account:

Children's privacy

Spark is strictly for users 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If we become aware that a user is under 18, we will immediately delete their account and associated data. If you believe someone under 18 is using Spark, please contact us at mj@sparkwus.com.

Security

We use industry-standard security practices to protect your data, including encrypted connections, secure credential storage, and limited internal access to personal information. No system is perfectly secure. If you have concerns about the security of your account, contact us immediately.

We may update this Privacy Policy as Spark evolves. If we make material changes, we'll notify you through the app or by email before the changes take effect. The date at the top of this page reflects the most recent update.
